Abstract

It is in the hands of every democratic state, or its government, to ensure that the legal environment is genuinely good. It is essentially a matter of determining ‘harmless’ obligations and ‘sound’ rules contained and published in laws. In so doing, the legal environment is influenced by the reflection of moral values accepted by the majority of society. Hence, it also shapes the development of a coherent state policy to be implemented by the state's organs within the scope of their competence. They are specifically commanded by law to carry out certain activities and nothing beyond them. It is the individual ministries and other central government bodies that are responsible for the proper administration of the law in the various spheres of the life of the state, as is clear from the Law on the Organisation of Government Activities and the Organisation of the Central State Administration (Slovak Act No. 575/2001, Art. 37). It means that they also take care of the good state of the legal environment in the field of public procurement, i.e. primarily the Ministry of Investment, Regional Development and Informatization of the Slovak Republic and the Office for Public Procurement.
