Abstract

The preservation of human society, and even more so its development, cannot do without further investment. It is enough to mention the current challenges in the form of reconstruction and construction of transport infrastructure, dealing with the energy future, the massive development of technology, as well as dealing with the consequences of various natural disasters and ensuring defense. To ensure the preparation and implementation of such investments, a contractual type of work contract will be primarily used. The regulation of the work (according to Sections 2586 - 2635 of the Civil Code) eliminates the dualism of the regulation of non-commercial and commercial contracts for work. The basis for the new draft regulation is the commercial code regulation, considering some foreign adaptations, because the concept of a contract of work in the former Civil Code followed its original concept of 1964 and the model of the Civil Code of 1950. In certain respects, account is also taken of certain provisions of the former International Trade Code (ITA), the normative structures of which were adopted by the Commercial Code, but which were often formulated more precisely and clearly in the ITA. The current issues of the works contract are the focus of this treatise.
